Minister Dias Toffoli, president of the CNJ, issued a recommendation to courts and judges throughout the country asking that the possibility of revoking provisional arrests of pregnant women, nursing mothers, mothers or people responsible for children up to twelve years old or people with disabilities, as well as the elderly, indigenous people, people with disabilities or those who fall into a risk group, be evaluated.
The objective of the recommendation, according to Toffoli, is to reduce the spread of coronavirus in prisons and in the system for juvenile offenders.
The document also suggests revoking preventive detentions lasting longer than 90 days, as long as they are related to crimes committed without violence or serious threat.
For regime progressions, the rule recommends that judges grant, when possible, house arrest to those in open and semi-open regimes.
The CNJ website says:
“The text considers that maintaining the health of people deprived of liberty, especially due to the situation of confinement and overcrowding in Brazilian prisons, is essential to guarantee collective health and public safety. It also highlights the importance of adopting measures to safeguard the health of professionals working in the criminal justice and socio-educational system while maintaining the continuity of the provision of justice.”
