Judge denies PT's request and does not ban banners calling Lula a 'drunkard' and 'thief'

Judge Fernando Machado Barboni denied on Tuesday, the 31st, the injunction requested by former president Luiz Inácio Lula da Silva to prohibit Luciano Hang, owner of the Havan stores, from funding and displaying messages about the PT candidate on the beaches of Santa Catarina. In early December, Hang stated on social media that he would sponsor planes to fly over the state's coastline carrying banners with slogans against the former president and this Saturday, the 28th, he published a video in which an aircraft shows the phrase "Lula, drunkard, give me back my money", reports Estadão.

In the judge's decision, Barbori points out that Lula is a public figure and is subject to criticism from the public. Furthermore, the judge notes that subsequent excesses may result in compensation for moral damages. "What is not allowed is prior censorship, which is not permitted by the 1988 Constitution.
