If there is no attribution of specific conduct to the accused, his preventive detention cannot be converted into flagrante delicto.
It was unanimously decided by the second panel of the STF. A criminal who has been caught cannot be held in preventive detention. This current composition of the STF tells the country that crime pays off and a lot.
But what is a “Flagrante”, right? Nothing. What matters is what the criminal says. And if he pretends to be “demented”, everything is fine.
The STF has become an institution without respect and hated by thousands of Brazilians who are trying to save the country from the hands of ministers who only create benefits for corrupt people and criminals. Then you ask yourself: “What is the current STF for?”, and you run the risk of being associated with anti-democratic movements and the like…
The ministers who are there have in turn already lost the support of representing the country's Supreme Court.
