On Tuesday, the 20th, the Supreme Federal Court (STF) decided to grant house arrest to “all” prisoners who have exclusive custody of people with disabilities and minors under 12 years of age.
The collective habeas corpus request is an expansion of the 'right to house arrest' that was granted to the “mother” prisoners in early 2018.
The STF only works in favor of criminals, an example of this was the release of André do Rap who fled to Paraguay. The entire system failed to release André do Rap.
The vote of Minister Gilmar Mendes, rapporteur of the case, was accompanied by his colleagues Edson Fachin, Cármen Lucia and Ricardo Lewandowski.
Before the opinions were read, Deputy Attorney General José Elaeres also spoke on behalf of the Federal Public Ministry (MPF) in favor of granting the HC.
Gilmar Mendes stated that there are 'concrete elements' that justify the conversion of preventive detention into house arrest under the terms requested by the Public Defender's Office. The minister cited the understanding established by the Supreme Court itself in a judgment in February of last year, which granted the benefit to pregnant women and mothers of children up to 12 years old.
Once again, Minister Gilmar Mendes favors criminals and shows that crime pays in Brazil.
