URGENT: Letter to the nation against the reelection of Alcolumbre and Maia is leaked by political parties and goes viral on the internet

Several political parties signed this Tuesday (1st) a “Letter to the Nation and the STF” against the possibility of re-election of the presidents of the Chamber and Senate, Rodrigo Maia and Davi Alcolumbre, and in defense of the Constitution, which is expressly against the measure.


The letter is signed by: PP, PL, PSD, Avante, Patriota, Solidariedade, PSC, PSB, Rede and Cidadania.
The STF, which should be the guardian of the Constitution, seems to be on the verge of declaring that our Constitution is unconstitutional. 
Such a fact will be an unacceptable aberration, if it actually happens.


Here is the letter:
 
“The undersigned parties, representing the most diverse political and ideological tendencies, express their deep concern regarding the judgment of the Direct Action of Unconstitutionality – ADI No. 6524, scheduled to take place this week in a virtual plenary session of the Supreme Federal Court.

What is at stake in this trial is the reaffirmation of the historical construction of Brazilian constitutionalism based on the postulate of republicanism, the alternation of parliamentary power and the prohibition of the personalist and individualized perpetuation of the administrative and functional control of the Legislative Houses.

The Brazilian democratic and representative system does not allow for dictatorship or parliamentary coronelism. The prohibition of reappointment to the same position in the immediately subsequent election in the Boards of the Chamber of Deputies and the Federal Senate (art. 57, §4°, of the Federal Constitution) is the most appropriate constitutional solution to avoid the perpetuation and rigidity of leadership positions in the National Congress, as also occurs in the boards of directors of the Judiciary.

It is also worth noting that the discussion of maintaining the reelection instrument within the Executive Branch is also part of the agenda of Brazilian society, and is even considered by many critics to be one of the most relevant factors in the institutional problems of our country that have been observed since its authorization in 1997 (EC No. 16).

 

A strong National Congress is one that respects the ideals of the temporality of mandates and the rotation of the leadership of its respective Houses. Changing this historical course violates the constitutional principle of prohibiting democratic regression and constitutes a narrow-minded casuistry that does not match the tradition of the Supreme Federal Court, guardian of the principles of the Federative Republic of Brazil and always attentive to harmony and institutional balance against individualistic attitudes of extrapolation and excesses in the exercise of power.”
